The Connecticut Constitution states, Claims against the state shall be resolved in such manner as may be provided by law.” Pursuant to that constitutional provision, the legislature established a procedure for resolution of claims against the state in Chapter 53 of the General Statutes , and General Statutes section 54-102uu , both of which were recently amended by Public Act No. 16-127. The statutes require claims against the state to be presented to a Claims Commissioner who is appointed by the Governor with the advice and consent of the General Assembly. The Office of the Claims Commissioner operates within the Department of Administrative Services for administrative purposes only, with independent decision-making authority.
